-3-

YI. Fish and Wildlife - Rules 2.04.11, 2.05.6(2), 4.18
The Division is in the process of contacting CDOW to determine whether
any additional fish and wildlife information will be required from
surface areas occupied by the three new lease areas. Any request for
additional information by CDOW will be forwarded to the applicant as
soon as possible.
VII. Operation Description - Rules 2.05.2, 2.05.3,(1) 2.05.3(2), 4.01
Section III of the permit application needs to be revised to provide a
description of the area of Land to be affected over the entire life of
the operation, according to the anticipated sequence of mining and
reclamation. Information presently contained within the application
appears to describe only those operations occurring within the current
permit term.
The D Seam and B Seam Mine Plan maps (maps 119 & 120) within the permit
application need to be revised to show the proposed mining lay out and
sequence within the three additional lease areas.
VIII. Subsidence - Rules 2.05.6(6), 4.20
Section III.A.S, of the permit application needs to be revised to
provide the following information:
~1. An inventory of all structures and renewable resource Lands
existing within and adjacent to the new lease areas. This would
''include such features as the county road, refuse haul road and mine
access road; any ponds, reservoirs, and drainages; and all mine-related
,facilities such as the overland conveyor, powerLine, and portion of the
~` waterline passing over panel RP-6.
~2. A description of the worst possible consequences which subsidence,
\lif it occurred, could have on each identified structure and renewable
resource land.
3. A determination of whether subsidence, if it occurred, could cause
material damage or diminution of reasonably foreseeable use of such
structures and renewable resource lands.
4. A brief description of subsidence related phenomena predicted to
occur within each of the additional lease areas. The subsidence
prediction informaton presently contained within the application should
be amended as necessary to reflect the re-orientation of the workings
and relocation of room & pillar and Longwall panels. Of specific
concern are the relocated room & pillar panels RP6 and RP7 which appear
to represent the thinnest overburden situation within the mine plan.
The applicant should specifically project the magnitude and nature of
subsidence anticipated to occur at the ground surface above those
panels.
