Page 2.05-45 was <br />amended to indicate the office will be razed. Page 2.05-27 was amended to <br />explain the remaining reclamation tasks. Map 23-1 was amended to show the <br />office removed. The office will be razed after the passive treatment pond is <br />removed. <br />Bear's negotiations with Arch regarding right-of-entry broke down about a year <br />ago. Bear will try to re-initiate discussions with Arch. <br />3. I do not believe Gunnison County has authority to approve or disapprove burial of <br />the office and concrete. Counties have not been consulted in the past for <br />approval of disposal of material on the mine sites. Furthermore, I do not believe <br />the County has any authority to approve retention or demolition of the bridge. <br />4. I do not know the status of the 10 pieces of rebar sticking out of the ground in the <br />area just west of the reclaimed exhaust fan portal. <br />5. The DMG is requesting that Bear demonstrate the backfilled and graded <br />slopes achieve a minimum factor of safety of 1.3. Bear explained its <br />position on this issue in its letter dated March 24, 2005. It is not <br />practicable for Bear to demonstrate a minimum factor of safety of 1.3 or <br />modify the slope to achieve the desired factor of safety. <br />6. I do not know the status of the small hole near the exhaust fan portal. <br />
