CRS 34-33-121(4) States that the provisions of the Act relating to permits, bonds, <br />inspections and enforcement, public review, and administrative and <br />judicial review are applicable to surface activities and impacts <br />incident to underground coal mining, with modifications to the permit <br />application requirements, permit approval or denial procedures, and <br />bond requirements as aze necessary to accommodate the distinct <br />difference between surface and underground coal mining. <br />Reeulations of the Colorado Mined Land Reclamation Boazd for Coal Mining <br />Regulation 2.05(3)(2)(b): Requires permit applications to contain a description of all proposed <br />surface disturbances to be associated with proposed underground <br />mining activities within the permit azea. <br />Regulation 2.05.6(6){f): Requires subsidence control plans to contain "a detailed description of <br />the measures to be taken to prevent subsidence from causing material <br />damage or lessening the value or reasonably foreseeable use of the <br />surface", including <br />(C) measures to be taken on the surface to prevent material <br />damage or lessening of the value or foreseeable use of the surface <br />including such measures as <br />(I) reinforcement of sensitive structures or features. <br />Regulation 4.01.1 States that Rule 4 "sets forth the minimum performance standards and <br />design requirements to be used for coal exploration, surface coal <br />mining and reclamation operations, surface coal mining and <br />reclamation operations incident to underground mining activities, and <br />special categories of mining". States that the performance standazds <br />and design requirements aze required to provide for: <br />(3) reclamation of all affected azeas to conditions that aze capable <br />of supporting the premining land uses or higher or better land uses. <br />
