Attachment <br />Colorado laws and regulations pertaining to the regulation of activities associated with the prevention of <br />material damage potentially resulting from underground coal mine subsidence. <br />Colorado Surface Coal Mining Reclamation Act: <br />CRS 34-33-109: Prohibits persons from conducting "surface coal mining and <br />reclamation operations" without a DRMS permit. <br />CRS 34-33-103(25): Defines "surface coal mining and reclamation operations" as "surface <br />coal mining operations" and all activities necessary and incident to <br />the reclamation of such operations. <br />CRS 34-33-103(26)(a): Defines "surface coal mining operations" as including activities <br />subject to the requirements of CRS 34-33-121 ("Surface Effects <br />of Underground Coal Mining") which involve surface operations and <br />surface impacts incident to an underground coal mine. <br />CRS 34-33-103(26)(b): Defines "surface coal mining operations" as including the azeas <br />upon which such activities [described in 34-33-103-(26)(a)] occur or <br />where such activities disturb the natural land surface, as including any <br />adjacent land the use of which is incidental to any such activities, and <br />as including excavations resulting from or incident to such activities. <br />CRS 34-33-121: Requires underground mine operators to prevent subsidence causing <br />material damage to the extent technologically and economically <br />feasible, maximize mine stability, and maintain the value and <br />reasonably foreseeable use of surface lands, except in those instances <br />where the mining technology used requires planned subsidence in a <br />predictable manner. <br />CRS 34-33-110(1): Requires persons desiring to conduct "surface coal mining and <br />reclamation operations" to submit as part of a permit application a <br />"reclamation plan" that meets applicable State law. <br />CRS 34-33-103(23): Defines "reclamation plan" as a plan for the reclamation of the <br />proposed "surface coal mining and reclamation operations" that meets <br />the requirements of CRS 34-33-111. <br />CRS 34-33-113(1): Requires applicants for DRMS permits to file a performance bond <br />that covers the area of land within the permit area upon which an <br />applicant will initiate and conduct "surface coal mining and <br />reclamation operations". <br />
