Two conditions make <br />this request necessary. First, Kilgroe-Atchison Construction <br />& Paving Co. has mined all of the materials it intends to <br />extract at the location and is in the process of closing its <br />operations. It is Mr. Atchison's intention to retire from <br />business as soon as possible. Second, Albert Frei & Sons, <br />Inc. has purchased or has an option to purchase approximately <br />83.061 acres of the 110.551 acres included in the original <br />permit. The balance of 27.49± acres remains in the ownership <br />of Mr. Jack Worthing. No additional mining or other dis- <br />turbances will affect Mr. Worthing's property. Only that <br />part of the property in the original permit which is now owned <br />by Frei is the subject of the technical revision. <br />Albert Frei & Sons, Inc. ("Frei") accepts responsibil- <br />ity for the successful completion of revegetation on the <br />Worthing, property. After a review of the ^1LRB inspection <br />report dated November 10, 1980, it appears that only the <br />successful revegetation of the bank areas around the two <br />Worthing lakes prevents release of the property now owned by <br />Mr. Worthing. Please refer to 19r. Atchison's letter of <br />January 7, 1981. <br />The U. S. Soil Conservation Service and Oikos Environ- <br />mental Services both recommend that further seeding be post- <br />poned to see if ungerminated seed now in the ground will grow <br />
