We recognize <br />that the Division will be short-handed by the holidays and <br />scheduled vacations, and for this reason, BMRI suggests that <br />the Division employ WWL to assist with the review of TR-16 <br />to meet the January 4, 1994 decision date. <br />TR-17, pursuant to the Board's directive to resolve issues <br />concerning process pipelines, was submitted at the request <br />of the Division as a mechanism to incorporate process water <br />pipeline specifications and maintenance procedures into our <br />permit. BMRI is in agreement with the Division to extend <br />the decision date for TR-17. BMRI believes that an <br />extension to February 1, 1994 will provide adequate review <br />time for forthcoming pipeline specification information. <br />Also, the extended review time of TR-17 should not interfere <br />with the on-going reviews of TR-15 and TR-16; this will <br />allow staggered deadlines for the in-process technical <br />revisions. <br />As a follow-up to BMRI's December 20, 1993 informational <br />telephone conversation with the Division, BMRI received the <br />verbal approval for deposition of tailings across the <br />upstream face of the main embankment prior to a final <br />decision concerning in-tailings piezometers. Deposition <br />along the main embankment face is necessary to re-establish <br />routine spigot sequencing after the extended construction <br />project interruption. The Phase I main embankment and liner <br />system continues to be the containment structure at the <br />present elevation of the tailings. As previously committed, <br />BMRI will not place tailings on the Phase II liner until <br />final approval of the as-built report has been completed. <br />BMRI will work diligently with the Division for a <br />final resolution of all outstanding issues concerning <br />the San Luis Project. <br />If you have any questions, please call. <br />Sincerely, <br />~~a S~t- <br />Alana L.
