(BM°,) - San Luis <br />DMG Permit No. M-8B-112 <br />Response to Division's Request for Additional Review <br />Time for TR-15, TR-16, and TR-17 <br />Dear Mr. Oehler: <br />On December 20, BMRI received a formal request from the <br />Division to extend the decision dates for TR-15 and TR-16 <br />from January 3 and 4, 1994 to January 14, 1994. Also, on <br />December 16, BMRI received a request from the Division for <br />additional information and additional review time for TR-17. <br />TR-15, ground water monitoring program, was submitted in <br />accordance with TR-08, Condition 3 which was developed and <br />approved in response to the April 1992 Board ordered <br />abatement program. Both BMRI and the Division look forward <br />to the conclusion of all abatement program issues in the <br />very near future. As BMRI has an approved monitoring <br />program in place, revising the decision date for TR-15 to <br />January 14, 1994 is acceptable. <br />TR-16 was submitted at the request of the Division as a <br />mechanism to incorporate an approved technical specification <br />field change of the embankment construction material into <br />our permit (Division's November 2, 1992 letter); the <br />Division received information about the construction <br />material field change in October (October 1 inspection and <br />Interim Construction Report, October 15). As the Division <br />is aware, the construction of the main embankment was <br />completed on December 12. In mid-October, the Division and <br />BMRI contracted with Water waste and Land (WWL) to provide <br />third party independent engineering oversight for the <br />project and to assis~ the Division with technical review <br />issues. As you know, BMRI is currently placing tailings in <br />the facility pursuant to verbal approvals from the Division <br />and technical oversight from WWL. In accordance with <br />previous discussions with Mike Long and others at the <br />Division, BMRI believes it is essential that any and all <br />lingering issues with respect to the tailings disposal <br />facility be resolved expeditiously. BMRI has structured its <br />plans and the schedules of its contractors under the <br />assumption that the review of TR-16 would be completed on <br />schedule.
