Dear Mr. Devereaux:
As a result of your call on January 10, 1996 to Mike Long, Division
Director requesting more direction in the formulation of a ground
water monitoring plan for the Landfill Pit, I am providing a
conditioned approval of Costilla County's plan which you submitted
to the Mined Land Reclamation Board during the Board's October 17,
1995 meeting in Denver. The conditions, listed below, will satisfy
the adequacy concerns that the Division has in regard to the plan
that the County proposed, concerns that were indicated to you in my
letter of October 23, 1995 which was both Faxed and mailed to you
on that date. The conditionally approved groundwater monitoring
plan proposed by Costilla County will be incorporated into the
permit for the Landfill Pit as Technical Revision 1.
The conditions to the Division's approval are:
CONDITION 1: The County will supply a map of the permit and
~ immediately surrounding area at a scale of 1 inch equals 500
feet on which the locations of the four proposed monitoring
(~ ~ wells will be indicated. This map will be provided to the
Division by March 1, 1996.
CONDITION 2: The County will position the proposed monitoring
wells so that at least one of them is hydrologically up
'1,. gradient from the pit, outside the area of influence of the
~~ pit and can be expected to represent background groundwater
(~ quality. At least one of the wells must also be hydrologically
down gradient from the pit in a position to intercept any
evidence of possible contamination of local groundwater by the
pit and to serve as a Point of Compliance as defined in the
Construction Materials Rules and Regulations.
