the emergency spillway will be at 6,127' in elevation. The embankment crest elevation is <br />at 6,128' in elevation, therefore allowing one-foot of freeboard. This configuration allows <br />a maximum storage capacity of approximately 0.94 acre feet. At a pumping rate of no <br />more than 200 gpm, the pond storage capacity will allow approximately 25 hours of <br />pumping volume. Certified as-built designs of the pond will be sent under separate <br />cover the end of the week. <br />Although Oxbow believes that the mine water will be suitable for discharge in <br />compliance with all parameters required for Outfall 011 of CDPS Permit # CO-0000132, <br />no specific water quality data is yet available for this determination. As such, Oxbow will <br />utilize the new pond to contain and treat the mine water, if necessary, discharging the <br />water from the pond through the temporarily relocated Outfall 011 upon approval by the <br />WOCD. <br />After the Sanborn Creek Mine has been rehabilitated, pumping from the in-mine sump to <br />the current location for Outfall 011 will be resumed. The temporary pumping location will <br />then be discontinued and the pond area reclaimed. The site will be returned to <br />approximate original contour and then seeded with Oxbow's approved seed mix.
