The public <br />notice by the applicant was published on June 22, 2000. The letters to various agencies dated <br />June 9, 2000, advised that the comment period for their response was 15 days later (June 26, <br />2000). The latest date of the two is July 3, 2000. <br />Rule 2.07.3(4)(a): The applicant shall make a full copy of his or her complete application for a <br />permit, permit revision, technical revision, or permit renewal, except for data and/or other <br />information if it is determined by the Division to be confidential according to 2.07.5, available <br />for the public to inspect and copy. This shall be done by filing a copy of rl:e application <br />submitted to t/te Division with the recorder at the courthouse of the county where the mining is <br />proposed to occur, or anot)ter equivalent public office if it is determined chat that office will be <br />more accessible to local residents than the county courthouse. <br />Certification of compliance to the Division is not required of the applicant. The public notice <br />published (on June 22, 2000) by the applicant indicted that the application could be viewed at the <br />Garfield County Clerk and Recorder's Office in the Garfield County Clerk and Recorder's <br />Office, Garfield County Courthouse, 109 8'h Street, Glenwood Springs, CO and at the Division. <br />A copy was on file at the Division as of May 24, 2000. The applicant had not placed a copy of <br />the application on file at the time of a request to review (in response to the Division letter dated <br />Lune 9, 2000) by a private law firm located in Glenwood Springs. The Division supplied a copy <br />for file, and it was on file as of June 20, 2000. <br />Rule 2.07.3(4)(6): The applicant shall file the copy of the cotttplete application less confidential <br />matters, by the first date of newspaper advertisement of the application. The applicant shall file <br />any subsequent revision of the application with the public office at the same time the revision is <br />subtttitred to the Division. <br />Certification of compliance to the Division is not required by the applicant.
