The Corrective Action Plan for the New Elk Mine dated April, 1994 <br />and the Second Quarter 1994 Groundwater Monitoring and Sampling Report dated June, 1994 have been <br />enclosed as a guide to some of these responses. <br />Rules 2.03.10,2.05.4(2)(h), and 2.05.6(1) <br />An Air Pollution Emissions Notice (ADEN) must be filed with the Colorado Departmen[ of Health <br />(CDH) located at 4300 Cherry Creek Drive South, Denver, CO., 80222-1530. No permit identification <br />numbers or licenses would be issued. This will comply with the Air Pollution Control Division which <br />has a primary to enforce the Clean Air Act within the State of Colorado. No modifications to the <br />current permits would be necessary. <br />2. Rule 2.04.7(1)(a)(v): <br />The purpose of the air sparge/vapor extraction system is to remediate hydrocarbon affected soils and <br />groundwater. The current concentrations of chemical in the groundwater is included in Table 2 of <br />the attached Second Quarter 1994 Groundwater Monitoring and Sampling Report. The concentration <br />that the constituents will be reduced to is unknown at this time. The goal of the system is to reduce <br />the contaminant concentrations below the Colorado Department of Health (CDH) cleanup guidelines <br />located in the CDH Storage Tank Facility Owner(Ooerator Guidance Documents dated December 11, <br />1992 <br />3. Rule 2.04.7(3): <br />No underground sources of water for domestic, agricultural, indus[rial, fish and wildlife, or other <br />legitimate uses have been affected by the leak from the underground diesel storage tank. <br />4. Rule 2.04.7(4)(b): <br />The symbols indicated on Map 13, "Sediment and Surface Water Control Plan, East Portal" are <br />monitor wells. A figure showing the correct map symbols is located as Figure 1 in the attached <br />Corrective Action Plan. The elevations of the corresponding wells are shown in Table 1 of the <br />attached Second Quarter 1994 Groundwater Monitoring and Sampling Report.
