J. J. Dudash - 2 - November 15. 2002
13. The discussion of current status of the mine was updated on page 2.05-i through 2.05-ii.
I was unable to prepare a brief discussion of subsidence monitoring. According to UTE
Engineering, they performed subsidence monitoring during 1997. I do not have a copy
of this 1997 data. Does the DMG have a copy? Enclosed are three amended pages
from Exhibit 22 which make some changes in the subsidence monitoring plan.
14. The Protection of the Hydrologic Balance section of the permit was updated regarding
the Edwards portal slide and the Operator's current understanding of the spring.
Enclosed are amended pages 2.05-55a through 2.05-55c.
15. A discussion of the Edwards portal spring discharge was added to amended page 2.04-
29b.
16. See item 3. above. According to discussions with past employees of Bear Coal
Company, the pond was constructed in an area that was previously disturbed so no
topsoil was salvaged.
17. The list of monitoring requirements on pages 2.04-30 and 2.04-30b were updated. The
requirement to monitor Lone Pine Gulch and the springs in Lone Pine Gulch was
deleted. Over seven years of monitoring data collected for the annual hydrologic reports
has shown the mine has not had a noticeable affect on the gulch or springs. August
sampling of the North Fork of the Gunnison River was added to the monitoring plan.
A summary of the Lone Pine Gulch springs are included as new pages 2.04-30iii
through 2.04-30vi.
18. The DMG will be notified as soon as Bear's NPDES permit is issued.
19. The current status of reclamation was updated on permit application page 2.05-i.
20. There an no exploration or other bore holes that reed to be reclaimed other than alluvial
monitoring wells AA-1 and AA-3.
21. No comment required.
22. No comment required.
23.
