LUNAGEMEM <br />The DMG's letter dated March 6, 2002 transmitted its comments and concerns regarding the <br />Bear No. 3 Mine permit renewal. On behalf of Bear Coal Company, Inc., following are its <br />responses to the DMG's comments and concerns. <br />1. The reclamation timetable in the permit was last updated 9/19/97 so it should be <br />accurate through 1997. I do not have any data that would help better define the dates <br />when the activities scheduled for June 1998 actually occurred. <br />2. Enclosed in a new Map 17 which shows the limits of the disturbed area. Also enclosed <br />in a new Page xi, List of Maps. <br />3. The sediment pond will be regraded to approximate original contour and reseeded. The <br />growth media will be analyzed for nutrients and amended as necessary. <br />4. The water monitoring plan on page 2.04-30b was updated to require August sampling <br />and analysis of the North Fork of the Gunnison (Upstream and Downstream) and active <br />discharge points for the analytes listed in the DMG's letter. <br />5. The DMG's suggestion to monitor the vegetation to get a sense for what the herbaceous <br />cover and production are on the reclaimed area is noted. Budget restraints will likely <br />prevent this monitoring. <br />6. I do not have a record of soil sampling to determine nutrient requirements. However, <br />plant growth on the reclaimed area is considered good. Is it necessary to perform soil <br />testing and amend the soil when there is good plant growth? <br />7. Enclosed are amended pages 2.03-8 through 2.03-18 which update the identification <br />of interest section of permit. <br />8. See item 7. above. The list of surface owners on page 2.03-10 has been corrected. <br />9. Page 2.03-8 was corrected to list only the persons who are officers and directors of the <br />company. <br />10. The identification of interests section was updated to shown the name change from <br />Pacific Basin Resources to Oxbow Carbon & Minerals. <br />11. Section 2.03.5, Compliance Information was updated. Bear Coal has not received any <br />violations in the past three years. <br />12. The list of other licenses and permits was updated. <br />
