Waldron ~ivislo 1 1984 <br />Division of Minerals and Geology nOiMinefaJS~~.eo~o <br />Department of Natural Resources gy <br />1313 Sherman Street, Room 215 <br />Denver, Colorado 80203 <br />Dear Mr. Waldron: <br />This responds to your October 13, 1994, letter concerning the Bear Mine <br />(Permit No. C-81-033) Permit Revision No. 2, According to your letter, Bear <br />Coal Company proposes to add 112.9 acres to their current permit area at the <br />Bear Mine located southeast of the town of Somerset, in Gunnison County, <br />Colorado. Your letter requests our "evaluation of the potential for impacts <br />to threatened or endangered species of plants or animals, or wildlife species <br />otherwise protected by federal law". <br />There is a proposed species and several candidate species that could be <br />impacted by this action. The Southwestern willow flycatcher (Empidomax <br />traillii extimus), which is proposed for listing as endangered, may occur <br />along the North Fork of the Gunnison River or in wetland areas within the <br />revised permit area. <br />We would like to bring to your attention species which are candidates for <br />official listing as threatened or endangered species (Federal Resister, Vol. <br />56, No. 225, November 21, 1991). While these species presently have no legal <br />protection under the Endangered Species Act (Act), it is within the spirit of <br />the Act to consider project impacts to potentially sensitive candidate <br />species.
