• 4.0 OTHER AGENCIES' ENVIRONMENTAL PROTECTION MEASURES AND <br />MONITORING <br />4.1 Colorado Department of Health Air Pollution Control Division <br />Air quality permits (89CS333(1-7)) were obtained by BMRI for the active mining phase of the <br />San Luis Project. The air quality permits provided for the maintenance of visible emissions and <br />particulate matter <l0µm (PMIO) within established limits. During active mining and <br />reclamation, BMRI achieved the air permit conditions by watering the haul roads on a regular <br />basis. In addition, magnesium chloride was applied to the haul roads 3 to 4 times per yeaz. <br />When the air quality permits were active there were three PMIO monitors on site that monitored <br />for PMio every three days. Since the termination of mining and beneficiation activities, air <br />quality monitoring has been terminated in accordance and compliance with the air quality <br />permits. <br />BMRI also maintains an on-site meteorological station that continually monitors precipitation, <br />temperature, wind direction, and wind speed. The meteorological data are repotlted to the Air <br />• Pollution Control Division on a quarterly basis. Reclamation activities associated with <br />recontouring and revegetation have lazgely been completed and there are currently no mining or <br />beneficiation activities at the San Luis Project. <br />4.2 Colorado Division of Water Resources <br />In November 1991, BMRI was awarded a Water Decree (Case No. 89CW32) that provided for <br />the augmentation of water extracted from the mine dewatering wells (during active mining) that <br />was subsequently used in [he milling circuit. Augmentation of the surface water flow in the Rito <br />Seco has been provided by pumping groundwater from a groundwater well located on the Rocky <br />Mountain Farms, which is located approximately 11 miles north of the San Luis Project. The <br />final Water Decree also stipulated that BMRI sample groundwater from locations in the vicinity <br />of the tailings impoundment, the Shalom Ranch well, and the San Luis municipal water supply <br />well. The Water Decree is currently active, and BMRI has submitted and received approval for a <br />Substitute Supply Plan from the State of Colorado Office of the State Engineer in letters dated <br />September 15, 1999 (from Bruce A.
