Cattany <br />(/~ ~ 'Sion Director <br />RE: Permit Amendment AM-04, enderson Mine and Mill, ermit No. M-1977-34~I al Resource Trustee <br />By a letter and attachments dated March 4, 2003, the Clear Creek County Commissioners provided <br />comments in favor of the approval of certain specific changes in post mining land use at the <br />Henderson Mine. These changes will allow the surface warehouse and maintenance shops, the <br />main office building and attached eating and shower facilities, as well as the sewage and potable <br />water systems to remain in the post mining setting to be put to industriallcommercial use. The <br />Division of Minerals and Geology (DMG) and the Mined Land Reclamation Board (NLRB) <br />appreciate the Commissioner's efforts and input to the pending reclamation permit amendment. I <br />am pleased to tell you that DMG will be recommending approval of the proposed post mining land <br />use changes at the mine site as supported by the Commissioner's letter and resolution. <br />In addition to a number of letters of support for the proposed permit amendment, the DMG also <br />received two letters objecting to certain aspects of Henderson's proposals. All of the objections <br />relate to the proposed changes to the reclamation plan at the Grand County Henderson Mill <br />facilities, and will have no affect on the proposal to allow certain buildings to remain at the mine <br />site in Cleaz Creek County. Since objections to the permit amendment have been received, the <br />DMG has scheduled apre-hearing conference in accordance with the NLRB rules and regulations. <br />Enclosed with this memo is the conference notice and summary of issues. As being on record in <br />support of the permit amendment, the Clear Creek County Commissioners and/or their staff are <br />welcome to participate in the pre-hearing conference. If the remaining issues are not resolved to the <br />satisfaction of the objecting parties at the pre-hearing conference, a hearing before the NLRB will <br />be necessazy. The Commissioners would be provided notice of such a hearing.
