Storrnwatn hlana¢ement Plans lSWMPsI: The purpose of a SWMP is to identify possible pollutant <br />sources that may contaminate stormKnter and to set out best management practices that, when <br />implemented, will reduce or eliminate any possible water quality impacts. <br />A SWMP has been developed for the Eagle Mine Complex. The SWMP shall be amended as necessary <br />and kept current in accordance with good engineering practices. 7ht plan shall idem~ potential source <br />of pollution which may reasonably be expected to affect the quality of storntwnter discharges associated <br />with industrial activity. /n addition, the plan shall describe and ensure the implementation of practices <br />which are to 6e used w redact the pollutanu in swrmwattr discharges associated with industrial activity <br />at the facility, and to assure compliance with the turns and conditions of this permit. Cyprus Empire <br />Carp. must implement the provisions of the SWMP as a condition of this permit. Contenu and <br />requirements of the SWMP are discussed in Part 1. C of the permit. <br />c. Compliance Dates: On September 7, 1993, Cyprus Empire Corp. submitted a SWMP, and cen~anon of <br />its implementation, to the Division jar the Eagle Mine Complex. The SWMP shall be updated as <br />appropriate. <br />d. Comprehensive Facility /nspections: The permittee will be required to make a thorough inspection of their <br />stormwater management system, at least twice per year (in the spring and fall). 7)iese inspections mart be <br />documented and summarized in the annual report. (See Part 1. C.6 of the permit. J <br />Annual Report: The permitree will be required to submit an annual report, covering January 1 through <br />December 31 of each year, an the overall compliance with the SWMP. <br />5. Economic Reasonableness Evaluation: Section 25-8-503(8) of the revised (June 1985) Colorado Water Quality <br />Control Act required the Division to "determine whether or cwt any or all ojthe water quality standard based <br />ejJluent limitations an reasonably related to the economic, environmental, public health and energy rmpacts to the <br />public and affected persons, and are in furtherance of the policies set forth in sec[ions 25-8-192 and 25-8-104. " <br />The Regulations for rlie State Discharge Permit System, 6.1.0, junkier define this requirement under 6.12.0 and <br />state: "Where economic, environmemal, public health and energy impacts to the public and affected persons have <br />been considered in the class~ations and standards sexing process, permitr wrinen to meet the standards may be <br />presumed to have taken into consideration economic factors unless: <br />aJ Anew permit Ls issued where the discharge was not in existence at the time of the class cation and <br />standards ruL^rnaldng, or <br />bJ /n the case oJ'a continuing discharge, additional information or factors have emerged that were not <br />anticipated or considered at the time of the clars~ation and standards rulemaking. " <br />
