Permit Coverage <br />Concern war expressed regarding the potential denial of general pnmit rovrrage and subsequent prohibition <br />against disahmge of stormwater, The draft general permits provided that if on review of the application for <br />cers~cation under a genera! permit, the Division derides that an individual pmnit is required, in some cases it <br />appeared that no discharge might be allaw+ad until an individual permit was issued which requires at least 180 <br />days. The general permiu base been clarified. The intent is !o temporarily authorize such discharges with a <br />general permit during the time the individual permit is being prepared. <br />E. Retort Due Dares <br />The permit has been rianfied to show the first possible due date for annual reports for ead+ permit type. The <br />permittee's arification will indicate the exact due date for the first annual repot. <br />F. Ezemotion for Pry-operational Miner <br />Concern was expressed regarding the exemption jot mining claims, prospects and exploration. The Divrsion has <br />clarified the rationale to explicitly state that pre-operational mining sites are not required to obtain stotmwater <br />permits. The definitions ojacti>,e and inacti>e mining sires do not include sites where mining claims are being <br />maintained prior to any disturbances associated with the extraction, benef~riation, or processing of mined <br />materials, nor sites where minimal activities are undertaken for the sole purpose of maimaining a mining claim. <br />Sites at which only aploration has been rnnducted are included in this exemption from stomiwater permit <br />requirements. <br />However, as clarijiaation, claims on land where there has been past earaction, benefiriation, or pronssing of <br />mining material, but there is currcmly no actisr mining, are ronsidend inactive sites and are subject to <br />stormwater regulations. <br />Sarah Plocher <br />September 10, 1992 <br />
