Sine, to the Division's knowledge, there is ro land in the Stare of Colorado for <br />which ~herev nor an itkmifrable owner., the Division feels that this is an unnecessary romplication of the <br />definition. Inactive mines ate defined simply as mining sites that arc nor being aaivrly mined. There Cr no invent <br />to make the definition more inclusive t/utn the definition in EPA's rcgulationt. <br />C. Submittal of Stosmwater Management Plant for Review and Approval <br />Several romments were rcreivrd regarding the submittal of Stormwatr Marutgement Plans (SWMPsJ ra the <br />Division for miew and approHaL Farsors cited in arguing against requiring submittal and approval of SWMPs <br />were: I) limited Division rcsourres to luuuile all the documents; 2) the Division acknowledganem that not all <br />documems would be reviewed,• and 3J tiu burden of reproducing information already comained in the CDMG <br />Reclamation Plan <br />/n reviewing the issue, the Division concluded that for metal mining operations SWMP developmem and <br />implemematian is still necessary, but submittal would only be required upon speck wrinen request by the <br />Division. Certhcntion that the SWMP leas been completed and implemented is now required. <br />1. Certif~caNon of SWMP Completion and Implementation: For active mining operations erirfing on October <br />I , 1992, rnr~aation of SWMP romplaion and implementation is required to be submitted to the Division ar <br />soon as possible but no later than the anniversary date of their Mined Land Reclamation pmnit that falls <br />between July 1, 1993 and June 30, I994. 77te cm~eation date for SWMP implementation has been <br />roordinated with the anniversary date of the reclamation permit to facilitate the review by CDMG and <br />potential madhcation gf reclmnation plans. Ibis coordination with the anniversary date will spread out the <br />potemia! impact on the CDMG. <br />For new active facilities (beginning operations after October I, 1992), and for all other active facilities <br />applying after July I, 1993, the SWMP shall be prepared prior to applying for coverage under the general <br />permit. <br />For inactive mining operations, applying before July 1, 1994, rert~cation of SWMP completion and <br />implementation is required ro be submitted ro the Division as soon as possible but na later than July 1, 1994. <br />For those applying after July I , 1994, the SWMP shall be prepared prior to applying for coverage under the <br />general permit. <br />2. Contents and Formal of Stotmwat'er Management Plata: Some activities required under the SWMP may <br />already be in plane. However, then SWMP will require the perminee to coordiruut these activities with any <br />nenssary new activities in an orderly manner, so that the rrsuh is the reduction or elimination of poUutams <br />reaching state waters from arras not limited by er/Iuent limitations. <br />The SWMP may rely upon information detrlopeod for abet similar pollution corurol programs such as the <br />SPCC (Spill Prevrmion Control and Countermeasures) plan or the Mined Land Reclamation Plan. <br />Appropriae portions of there othn• plans may be inrorporated in the SWMP by referenre, as long as a <br />complete SWMP tnrr be reproducni and submitted to the requesting agenry within the time frame specified in <br />the request. Those portions of the rcfercnrnd documents cons! be included in the submittal. The SWMP must <br />also be readily available to an on-site inspector. <br />3. Coordination With CDMG: It is the petmiaee's responsibility to notes the CDMG of any changes at tbeir <br />sire resulting from the implementation of the SWMP. This is so that tlu CDMG may review the SWMP and <br />inrorporate any potemial revisions imo the facility's rcc4unation permit which might be needed.
