The inspection was performed by
myself, john Effinger III, a registered professional engineer in the State of Colorado since
December, 1975. I have experience and knowledge in the design and construction of
dams, drainage control, hydrology and structures; including experience in portions of the
permitting process of coal mine facilities and permit compliance.
The purpose of this inspection and certification was to ensure that proper
construction and maintenance techniques were being utilized in accordance with the
approved refuse disposal plan and to satisfy the requirements of Rule 4.10.2 (1) of the
Colorado Mined Land Reclamation Board for foal Mining. In addition to the on site
inspection referenced above, actions taken in preparing this certification included review
of the results of field compaction testing performed by your consultant, Kleinfelder, Inc.,
dated September 1 S, 1998, review of the re-evaluated stability analysis performed by your
consultant Terra Matrix, dated December 9, 1996, and review and discussion of.several
applicable mine maps and state regulations with yourself at your mine site otFice.
Said inspection was performed on a mild (80°), clear Wednesday morning by
myself. Most of the site was traversed with a'inotorcycle with frequent stops and hiking
trips over, across and around the pile. The following is a statement of my professional
observations and conclusions from this inspection:
The entire pile was examined for any failures and none found.
The entire pile was checked for any springs or seeps and none found.
