PART I. AUTHORIZATION TO CONSTRUCT AND OPERATE <br />Pursuant to the Underground Injection Control Regulations <br />of the U. S. Environmental Protection Agency codified at Title 90 <br />of the Code of Federal Regulations, Parts 124, 144, 146, and 147, <br />Natural Soda, Inc. <br />818 Taughenbaugh, P.O. Box 1330 <br />Rifle, Colorado 81650 <br />is hereby authorized to construct and operate Class III Solution <br />Mining wells within the proposed Area Permit on its Rock School <br />sodium lease, Rio Blanco County, Colorado (figure 1). The Area <br />Permit (figure 2) is defined as follows: <br />Area Permit within Rock School Lease <br />E1/2 NW1/9 Section 20, W1/2 NEI/9 Section 20 <br />Township 1 South, Range 98 West <br />Rio Blanco County, Colorado <br />This permit authorizes a Class III Solution Mining Well(s) <br />Area Permit for the purpose of extracting the mineral Nahcolite <br />(NaHCO,) by use of a solution mining process (figure 3) with <br />elevated temperature and pressure. <br />Three (3) solution mining wells, wells 2, 3, and 4 of <br />figure 4, are initially approved for construction and operation <br />by issuance of this permit. Injection shall not commence until <br />the operator has fulfilled all applicable conditions of this <br />permit and has received written authorization from the Director. <br />"Prior to Commencing Injection" requirements are set forth in <br />Part II, Section C.1. of this permit. <br />Additional Class III injection wells within this area <br />permit are authorized under 90 CFR 149.33{c)(2), provided the <br />operator notifies the Director prior to construction of the well <br />or wells, submits all information required by this permit, <br />provides a demonstration of financial responsibility to plug and <br />abandon the new well prior to any well construction, and receives <br />written authorization for injection to commence. <br />All conditions set forth herein refer to Title 40 Parts <br />124, 149, 146, and 197 of the Code of Federal Regulations and are <br />regulations that are in effect on the date that this permit <br />becomes effective. <br />Page 5 of 120 <br />EPA FINAL Area Permit No. C03870-00000 <br />
