PART Q <br />Page 2l <br />Permit No. COG-500000 <br />B. RESPONSiBILiTIES <br />l) Promulgation of Water Quality Standards applicable to waters affected by the permitted discharge; <br />2) Effluent limitations or other requirements applicable pursuant to the State Act or federal requirements; <br />3) Control regulations promulgated; <br />4) Data submitted pursuant to Part 1.D indicates a potential for violation of adopted Water Quality Standards <br />or stream classifications; or <br />5) Removal of a temporary modification to a stream standard thereby requiring the application of the stream <br />standard. <br />c. This permit, or certification under this permit, tray be modified in whole or in part to include new effluent <br />limitations and other appropriate woditions where data submitted pursuant to Part I.D indicates that such <br />effluent limitations and conditions are necessary to ensure compliance with applicable water quality standards <br />end protxtion of classified uses. <br />d. At the request of the permittce, the Division may modify or terminate certification under this permit if the <br />following conditions are met: <br />1) In the case of termination, the pertnittee notifies the Division of its intent to terminate the operation 90 <br />days prior to the desired date of termination; <br />2) In the case of termination, the permittee hs ceased any and ell discharges to state waters end <br />demonstrates to the Division there is oo probability of further uncontrolled discharge(s) which may affect <br />waters of the State. <br />3) The Environmental Protection Agency has been notified of the proposed modification or termination end <br />does not object in writing within thirty (30) days of receipt of notification; <br />4) The Division finds that the permittee bas shown reasonable grounds consistent with the Federal and State <br />statutes and regulations for such modification, amendment oc termination; <br />5) Fee requirements of Section 6.16.0 of State Discharge Permit System Regulations have been met; and <br />6) Requirements of public notice have been met. <br />6. Oil and Hazardous Substance Liability <br />Nothing in this permit shall be construed to preclude the institution of any legal action or relieve the permittee from <br />any responsibilities, liabilities, or penalties to which the permittce is or may be subject to under Section 311 (Oil and <br />Hazardous Substance Liability) of the Clean Water Act. <br />Laws <br />Nothing in this permit shall be construed to preclude the institution of any legal action or relieve the permittce from <br />any responsibilities, liabilities, or penalties established pursuant to any applicable State law or regulation under <br />audtority granted by Section 510 of the Clean Water AM. <br />8. Permit Violations <br />Failure to comply with any terms and/or conditions of this permit shall be a violation of this permit. <br />
