water users, while permitting applicant Clexibility in determining <br />the allocation of its water resources. So long as applicant's <br />uses conform to this formula and net depletions of the Colorado <br />River system do not exceed 4h0 acre feet per year, then no in- <br />jury will occur to the rights of other water users. <br />7. Applicant's proposed chang@ of water right involves <br />moving the point of diversion of the Vulcan Ditch priorities from <br />a tributary to the mainstem river. Such a change could have the <br />effect of enhancing the physical supply of water available to appli- <br />cant, to the detriment of rights on the mainstem river and the <br />river system as a whole. In addition, water left in Canyon Creek, <br />to the extent of water taken through the wells, may be subject to <br />interception by junior water rights prior to reaching the Colorado <br />River mainstem, where it is required in order to avoid injury to <br />users thereon. If applicant is required to install a measuring <br />device in Canyon Creek or on the Vulcan Ditch headgate to insure <br />that its supply of water would not exceed the amount that would have <br />been available to it at the historic point of diversion, and means <br />to insure the delivery of water to the Colorado River in such amount; <br />as is being diverted from the alternate point of diversion, proper <br />administration can be facilitated. <br />CONCLUSIONS OF LAW <br />The Court finds as a matter of law: <br />1. The change of water rights proposed by applicant is <br />one contemplated by law, and if administered in accordance with <br />this decree, there will be no adverse effects on any vested water <br />rights on the Colorado River system. <br />2. The State Engineer may be lawfully required to ad- <br />minister the priority in the manner set forth herein. <br />DECREE <br />IT IS, THEREFORE, ORDERED, ADJUDGED AND DECREED: <br />1.
