Mr. John Hazdaway • • <br />January 2, 1996 -Temporary Conditions <br />Page 2 <br />b) If cyanide concentration for any analyses at any one of the ground water monitoring <br />points in Arequa or Wilson Gulches exceeds .2 mg/1 WAD cyanide and the pH of the <br />collected solution exceeds 9.0, then the pennittee shall assume that a "failure or <br />imminent failure" in the active Cresson Valley leach facility has occurred for emergency <br />response purposes. <br />c) If either (a) or (b) occurs, the permittee shall notify the Office according to the <br />provisions of Rules 8.1 and 8.2. In addition to the requirements of Rule 8.2.2, the <br />notice shall include copies of the actual laboratory analyses report data sheen, the date <br />samples were collected, the sample points sampled, the method of sample preservation <br />and the name of the person that collected the samples. <br />d) Immediately upon the permittee's own determination, or notice from the Division of an <br />emergency situation or condition, as specified in No. 1(a) or (b) above, the permittee <br />shall initiate all necessary and appropriate measure to collect and detoxify leaking, <br />spilled or released solutions from the Cresson Valley leach facility. The permittee shall <br />immediately cease the application of fresh cyanide~ontaining solutions to the Cresson <br />Valley leach facility. The permittee shall initiate all measures that aze appropriate and <br />necessary to reduce, rn;nim;~r and stop, where technically possible, the loss of <br />contaminated solution from the Cresson Valley teach facility. <br />e) As soon as practicable after an emergency situation or condition is reported and <br />addressed, the permittee shall wmply with the provision of Rule 8.2.3. <br />f) All contaminated fluids, according to No. 1(b) above, in ground water monitoring wells <br />shall be collected, stored (not to exceed 60 days), detoxified to applicable surface water <br />standazds and released. All fluids contaminated according to No. 1(a) above shall be <br />collected, stored (not to exceed 60 days), detoxified to applicable surface water standazds <br />and released. Under no circumstance is the operator to return these contaminated waters <br />into the ground water system. <br />g) Under no circtmstance shall any of the fluids collected in No. 1(f) be introduced into the <br />heap leach facility. The heap leach facility, for the purpose of this condition, shall <br />include the azea delineated by the footprint of the valley fill heap leach. <br />h) Where data indicate conditions described in No. 1(a) or (b) above, the permittee shall <br />monitor (sample and analyze) all sample points daily until the emergency situation or <br />condition defined by No. 1(a) or (b) is shown not to exist. The emergency situation or <br />condition defined by No. 1(b) will no longer exist if: 1) three (3) consecutive ground <br />water samples taken seven (7) days apart from any sump that has WAD cyanide less than <br />or equal to .2 mg/l and the pH measured on the same days and at the same sample <br />points is less than or equal to 9.0 pH; and 2) the five (5) consecutive LDS samples taken <br />seven (7) days apart from any sump that has WAD cyanide less than or equal to .5 mg/1 <br />and the pH measured on the same day at the same sample is less than or equal to 9.0. <br />The operator shall remove three (3) wells volume on each sample day prior to sampling <br />for WAD cyanide and pH. <br />
