P., <br />Permit No. CO-0045161 <br />Dear Mr. Gates, <br />Colowyo Coal Company respectfully requests your review of our CPDS Permit Renewal <br />Application, Permit No. CO-0045161. <br />Enclosed you will find the permit application and the respective maps and exhibits for <br />your review. In addition, Colowyo has identified requested revisions to the new permit. <br />As per our discussion at your office on September 12, 2003 we believe that the <br />enclosed permit application is complete and correct. <br />Colowyo requests the following revisions to our CDPS permit; <br />1. Colowyo requests to discontinue the monitoring requirements associated with <br />the "B" designated ponds with the possible exception of ouffall 0026. We <br />feel that there has been sufficient sampling history from 002B to warrant the <br />discontinuation of additional discharge monitoring in the future but Colowyo is <br />prepared for further discussion on the matter, <br />2. Colowyo requests the ability to pump stored water from A & B designated <br />ponds for general use specifically for dust control i.e. application to haul <br />roads within the permit area. <br />3. Colowyo requests the ability to facilitate one-time discharges to the surface <br />waters below the A ponds for the specific purpose of pond maintenance and <br />cleanout. Discharges would consist of short-term (24-48 hour) releases of <br />pond water and would be performed only after notice was given and <br />permission received from CDPHE personnel. <br />4. Colowyo requests the ability to drain backwash water from the proposed <br />new reverse osmosis water treatment plant to an unlined storage pond. <br />Colowyo respectfully requests use of this water for dust suppression on <br />//~ Kennecott <br />~ .Energy ~__, <br />Colowyo Coal Company L.P ~ <br />
