We will forward SW TKO's commitment to not remove any structures nor <br />encroaching any closer than the setbacks set forth in the stability analysis without <br />authorization of the structure owner shortly. Refer to Attachment 7 for excerpts from the Kerr <br />McGee surface use agreement. <br />19. Exhibit 3 of 7 depicts the mining set back distances from various permanenfman-made <br />structures on site. Please depict the mining offset distance form the gas pipeline behveen <br />Areas 10 and 12, and update the map accordingly. <br />The Mining Plan Map depicts a 30' minimum setback on either side of the gas pipeline <br />mentioned above. (Refer to Attachment 3.) <br />20. The applicant states that settling ponds will be located in the processing area. Please identify <br />the location of these ponds and provide additional detail regarding the construction, use and <br />management of these structures. !n addition, explain how the ponds will be reclaimed. <br />The settlinglsilt pond and fresh water pond are denoted as Phase 1, 1A and 2 of the Mining <br />Plan Map. These areas will be mined at the beginning of the operation and used as a <br />settlinglsilt pond and fresh water pond for the life of the mine. Fines from processed material <br />and processing water will be pumped into the settlinglsilt ponds and the fines/silts will be <br />allowed to settle out. Water will be drawn from the top of the ponds and pumped to the fresh <br />water pond so that it can be reused in the washing process. Once the settlinglsilt ponds are <br />full, they will be reclaimed as upland. The fresh water pond will be backfilled with <br />overburden and reclaimed as upland. <br />21. Please state how pit runoff will be diverted to the two silt ponds located on the north end of <br />the mine site. Please further explain their use, management and how water will be diverted <br />into the silt ponds and provide any ditch or conveyor designs if applicable. It was discussed <br />during the inspection of March 4, 2005 that the silt pond 6.7 acres in size located west of area <br />i is no longer in the proposed mining and reclamation plan. Ptease revise the maps <br />accordingly. <br />The processing water for phases 4 through 9 will be diverted to the two settling ponds on the <br />north end of the site. The operator will utilize the same process as described in response <br />number 20, but rather than pumping the water to the settling ponds in phases 1 and 2, it will <br />be pumped and conveyed via the pipeline shown on the Mining Plan Map to the settling pond <br />in phase 3. We do not anticipate that a ditch would be used to convey the water and fines. <br />The pipe would run in conjunction with the conveyor crossing across WCR 8. <br />
