Please inform the Division as to when topsoil piles will be reseeded to prevent wind and water <br />erosion. In addition, please provide a temporary seed mixture fo be used on topsoil and <br />overburden piles. <br />The topsoil berms will be seeded as soon as weather permits after they are constructed. <br />The applicant wilt be selling all overburden and excess topsoil throughout the mining <br />process. Topsoil stockpiles that are not used for berming will be seeded within 45 days <br />(weather permitting) if it is during the growing season and if they are not being disturbed <br />regularly. Per the Colorado Natural Heritage Program's request, stockpiles will be seeded <br />with Luna pubescent wheatgrass andlor Amur immediate wheatgrass. Seeding will be done <br />at a rate of 15 pounds pure live seed per acre. <br />The City of Fort Lupton noted in their objection letter that they wanted assurance that "the <br />unsightly appearance of open mine areas rs minimized]" and fhaf reclamation and <br />revegetation is prompt and timely." As a result, we request the following permit conditions: <br />a. The mine operator will construct perimeter berms, as shown on the mining and <br />reclamation plans, at the beginning of each respective mining phase. The berms shall <br />be seeded with the specified seed mix in the fall or the spring. <br />b. The mine operator shall install irrigation, trees and shrubs as soon as it is feasible after <br />the berms have been constructed. Planting for deciduous trees shall occur prior to <br />October 15~ and after March 151h. Planting for evergreen trees shall occur prior to <br />October 151 and after March 15"x. <br />15. The applicant intends to irtstaR a conveyor structure over Weld County Road 8.25 and Weld <br />County Road 8. Please provide additional information regarding the conveyor s Wcture (i.e. <br />composition, length, width, height, foundations, etc.) and a specific plan for reclamation of the <br />conveyor structure. In addition, please provide documentation for the legal right to enter the <br />easement associated with the conveyorstructure proposed overWefd County Road 8.25 and <br />8. <br />Please refer to Attachment 2 for documentation of the legal right to cross over WCR 6.25 <br />and WCR 8. We vnll forward the additional information regarding the conveyor structure in a <br />separate letter. The conveyors and crossing structures will be assets owned by the operator. <br />If the operator was to cease operations and the Division was forced to reclaim the site, the <br />operator would remove the conveyors. Even if the operator did not take the conveyor, it <br />would have a market value that would more than offset the cost to remove it. However, the <br />concrete foundations for the conveyor crossings could be included in the reclamation cost <br />estimate. The operator estimates that it would cost $20,000 per crossing to remove or <br />$40,000 total. <br />
