<br /> <br />and reclamation procedures will be followed in the mining operation of <br />Clayton in SW's, Section 12, T1S, R76W, Grand County, Colorado, and Clayton <br />hereby agrees to faithfully perform the land stabilization and reclamation <br />work required herein. <br />1. Clayton caill stockpile and retain topsoil wherever possible. <br />2. If Clayton plans to discharge into a waterway'a permit to <br />discharge into same will be obtained from the Environmental Protection <br />Agency and Clayton will abide by the regulations pertaining thereto or those <br />set by the Colorado Water Quality Control Commission. <br />3. Clayton will control erosion on or along haul roads by the <br />use of drainage ditches, culverts or check dams. <br />4, Daily operations will not begin before 6:00 a.m. nor extend <br />past 10:00 p, m. <br />5. Blasting will be conducted during daylight hours only and in <br />a manner to alleviate or curtail shock and concussion nuisance by controlling <br />I the size of the blast. <br />6, Clayton will monitor fugitive dust resulting from this operation <br />to keep same in compliance with the dust emission standards set by the Air <br />Pollution Control Commission of the State of Colorado. <br />7. Clayton will proceed with the plan as outlined in the <br />reclamation plan within three (3) years after the cessation of operations <br />covered by the permit application. + <br />8. Trailers and/or buildings used for office, storage, and mainte- <br />nance shall meet local zoning regulations. <br />9, Special use or other forms of permits shall be obtained from <br />the county agency authorized to grant such permits. <br />10. Clayton will provide and stabilize a finished slope to a ratio <br />no steeper than one and one half (12) horizontal to one (1) vertical. <br />11. Natural drainways, or drainways constructed to alleviate flood <br />conditions in the area shall be kept free from overburden, stockpiles and <br />topsoil. <br />12. Clayton ~ai11 grade and stabilize any surface area disturbed by <br />this operation and revegetate the area, following the best information <br />available from qualified organizations or persons. <br />-2- <br />.: <br />
