i~ ~ <br />~ III IIIIIIIIIIIIIIII - <br />LAND RECLA,~fATION BOARD <br />Department of Natural Resources <br />Room 215, 1S45 Sherman St. Telephone: 892-3401 <br />Denver, Colorado 80203 <br />Land Stabilization and Reclamation A,reement <br />THIS AGREEMENT is entered into this 2 2~ day of~~ . , <br />1974 by and between THE STATE OF COLORADO, by and through its Director of <br />Natural Resources and the Land Reclamation Board (hereinafter referred to <br />as "State") and Clayton & Son Construction Company (hereinafter referred to <br />as CLAYTON. <br />W I T N E S S E T H <br />LTHEREAS, Clayton desires to operate a sand & gravel mine in <br />SW's, Section 12, Township 1 South, Range 76 LJest, Grand County, Colorado, <br />better known as the Murphy Crooked Creek Pit; and, <br />WHEREAS, Clayton has submitted a plan on the Proposed Land <br />Stabilization and Reclamation Procedures for the proposed sand 6 gravel <br />mine operations; and, <br />WHEREAS, Said Murphy Crooked Creek Pit will be operated for the <br />purpose of extracting sand & gravel for commercial marketing and, <br />WHEREAS, The Colorado Open Mining Land Reclamation Act provides <br />statutory authority for the Land Reclamation Board of the State of Colorado , <br />to enter into agreements with operators or persons in charge of mining <br />operations such as those contemplated by Clayton to insure that the <br />necessary stabilization and reclamation caork will be done to prevent land- <br />slides, floods or erosion. This section of the law further provides that <br />the Land Reclamation Board requires a performance bond conditioned upon the <br />faithful performance of the stabilization caork required by the Board; and, <br />L+fHEREAS, The Land Reclamation Board has determined that thz <br />mining operation to be conducted by Clayton in said Section 12 could have <br />an adverse effect on the environment and could result in landslides or erosion <br />if proper stabilization and reclamation procedures are not followed. <br />NOW THEREFORE, Pursuant to the authority set forth in the <br />Colorado Open Ptining Land Reclamation Act, the Land Reclamation Board of <br />the State of Colorado has determined that the following land stabilization <br /> <br /> ~ - -- <br /> <br /> <br />
