The river banks should not be affected by the proposed operation. Staff <br />determined that the application appropriately addressed protection of surface and groundwater <br />systems from pollution, in accordance with the Act and Rules. <br />See staff response under items 3j, 3k, and 31 of DMG's Rationale for Approval Recommendation. <br />6. /s the topsoil replacement p/an adequate? <br />Staff determined that the portion of the reclamation plan addressing salvage, storage and <br />replacement of topsoil, supported the post mining land use and demonstrated compliance with the <br />performance standards of Rule 3.1.9 and C.R.S. 34-32.5-116(4)(8), (jl and (p). <br />See staff response under items 4j and 4m of DMG's Rationale for Approval Recommendation. <br />7. is the proposed amounf of the financial warranty adequate to cover the costs of reclamation? <br />Pursuant to Rule 4.2.1(4) and C.R.S. 34-32.5-117(4)Ib)(11, staff calculated the total cost of <br />reclamation for the first year of operations at 532,962. <br />8. Should the Applicant be required to monitor water quality as a part of site reclamation? <br />The application indicates that pit dewatering will be necessary and that a discharge permit through <br />the Water Quality Control Division of the Colorado Department of Health and Environment (WQCD), <br />will be acquired. Water quality monitoring of discharged waters will be addressed through the <br />Colorado Discharge Permit System, permitted and enforced by the WQCD. <br />Staff review of the application did not identify potential for adverse impacts to groundwater quality. <br />Groundwater will be exposed by mining operations. Therefore the application states that a well <br />permit through the Division of Water Resources of the Office of the State Engineer of the Colorado <br />
