<br /> <br />§ias.io <br />(4) For Class III wells where the Director elects <br />to rely on cementing records io demonstrate the <br />absence of signiFlcant fluid movement, the mom <br />itonng program prescribed by § 146.?3(h) shall be <br />designed to verify the absence of significant Ouid <br />movement. <br />(d) The Director may allow the use o(a test to <br />demonstrate mechanical imegrity other than those <br />listed in paragraphs (b) and (c)(?) of This section <br />wish the written approval of the Adminislmmr. To <br />obtain approval, the Director shall submit a written <br />request to the Administrmor, which shall set forth <br />the proposed test and all technical data supposing <br />its use. The Administrator shall approve the re- <br />quest d it will reliably demonstrate the mechancal <br />integrity of wills for which its use is proposed. <br />Any alternate method approved by the Adminis- <br />trator shall be published in the FEDER.LL REGISTER <br />and may be used in all Smtes unless its use is rc- <br />stncted at the lime of approval by the Adminis~ <br />Iralor. <br />(e) In conducting and evaluating the tests enu- <br />memled in this section or others to be allowed by <br />the Director, the owner or opermor and the Direc- <br />tor shall apply methods and standards generally <br />accepted m Iht industry. When the owner or optr- <br />alOr rCPOnS Iht re5a115 of mechanical m[tgrity <br />tests to the Director, he shall include a descnplion <br />of the testl5) and the mtthodls) used. I. 19831 <br />§146.10 Plugging and abandoning <br />Class I-III wells. <br />(a) Prior to abandoning Class I to III wells the <br />well shall be plugged with cement in a manner <br />which will not allow the movement of Ouids either <br />into or bttwetn underground sources of drinking <br />water. The Director may allow Class III wells to <br />use aher plugging materials if he is satished That <br />such materials will prevent movemem of Owds <br />into or between underground sources of drinking <br />water. <br />(b) Plaremem of the cemem plugs shall be ac- <br />complished by one of the following: <br />(U The Balance mahod; <br />(2) The Dump Bailer method. <br />(3) The Two-Plug method: or <br />(4) An alternative method approved by the Di- <br />rector, which will reliably provide a comparable <br />level of protection to underground sources of <br />drinking water. <br />Ic) The well to be abandoned shall be in a stale <br />of static equilibrium wnh the mud weight equal <br />¢ed top to bottom, either by circulating the mud <br />in the well al last once or by a comparable meth- <br />od prtscnbtd by the Director, prior to the place- <br />mem of the cement plug(s). <br />(d) The plugging and abandonment plan re- <br />quired in 40 CFR 144.5?(a)(6) and 144.51(n) <br />shall, in the case of a Class III project which <br />underlies or is in an aquifer which has been ex- <br />empted under 10 CFR 146.04. also dtmonstime <br />adequae protection of USDWS.
