(4) For Class III wells where the Director elects
to rely on cementing records io demonstrate the
absence of signiFlcant fluid movement, the mom
itonng program prescribed by § 146.?3(h) shall be
designed to verify the absence of significant Ouid
movement.
(d) The Director may allow the use o(a test to
demonstrate mechanical imegrity other than those
listed in paragraphs (b) and (c)(?) of This section
wish the written approval of the Adminislmmr. To
obtain approval, the Director shall submit a written
request to the Administrmor, which shall set forth
the proposed test and all technical data supposing
its use. The Administrator shall approve the re-
quest d it will reliably demonstrate the mechancal
integrity of wills for which its use is proposed.
Any alternate method approved by the Adminis-
trator shall be published in the FEDER.LL REGISTER
and may be used in all Smtes unless its use is rc-
stncted at the lime of approval by the Adminis~
Iralor.
(e) In conducting and evaluating the tests enu-
memled in this section or others to be allowed by
the Director, the owner or opermor and the Direc-
tor shall apply methods and standards generally
accepted m Iht industry. When the owner or optr-
alOr rCPOnS Iht re5a115 of mechanical m[tgrity
tests to the Director, he shall include a descnplion
of the testl5) and the mtthodls) used. In making
his/her evaluation, the Director shall review mon-
itoring and other test data submitted since the pre-
vious evaluation.

§ 146.9 Criteria For establishing per-
mitting priorities.
In determining priorities (or setting times for
owners or operators to submit applications for au-
Ihorizaiion to infect under the procedures of
§ 144 31 (al. (c), (g) or ¢ 144.??(Q, the Director
shall bast these priorities upon considermion of
the following (anors.
(a) Injection wills known or suspected to he
comaminating underground soarers of drinking
water;
Ib) Injection wells known to be injecting Owds
containing hazardous contanunanls:
(c) Likelihood of contamination of underground
sources ofdrinking water:
fd) Potentially affected population;
(e) Injection N'Clls violating existing Stale re-
quirements;
(~ Coordination with the issuance of permits re-
quired by other Stale or Federal permit programs;
lg) Age and depth of the injection well, and
(h) Expiration dates of exaung State permits, i(
any.

§146.10 Plugging and abandoning
Class I-III wells.
(a) Prior to abandoning Class I to III wells the
well shall be plugged with cement in a manner
which will not allow the movement of Ouids either
into or bttwetn underground sources of drinking
water. The Director may allow Class III wells to
use aher plugging materials if he is satished That
such materials will prevent movemem of Owds
into or between underground sources of drinking
water.
(b) Plaremem of the cemem plugs shall be ac-
complished by one of the following:
(U The Balance mahod;
(2) The Dump Bailer method.
(3) The Two-Plug method: or
(4) An alternative method approved by the Di-
rector, which will reliably provide a comparable
level of protection to underground sources of
drinking water.
Ic) The well to be abandoned shall be in a stale
of static equilibrium wnh the mud weight equal
¢ed top to bottom, either by circulating the mud
in the well al last once or by a comparable meth-
od prtscnbtd by the Director, prior to the place-
mem of the cement plug(s).
(d) The plugging and abandonment plan re-
quired in 40 CFR 144.5?(a)(6) and 144.51(n)
shall, in the case of a Class III project which
underlies or is in an aquifer which has been ex-
empted under 10 CFR 146.04. also dtmonstime
adequae protection of USDWS. The Director shall
prescribe aquilr champ and monitonng where he
deems it necessary and feasible to insure adequate
protection o(USDWs.
