<br />4146.3 <br />4146.3 Definitions. <br />The following definitions apply to the under- <br />ground injection control program. <br />Abnndnned well means a well whose use has <br />been permanently daconunued or which is in a <br />start of disrepair such that a cannot be used (or <br />its imended purpose or (or observation purposes. <br />Adminisrraror means the Adtmnistmtor of the <br />United States Environmental Protection Agency. <br />or an authorized represenmtive. <br />Applicannn means the EPA standard national <br />(ortns (or applying for a permit, including any ad- <br />ditions, revisions or modifications to the forms; or <br />forms approved by EPA (or use in approved <br />States, including any approved modifications or re- <br />visions. For RCRA, application also includes the <br />information required by the Director under <br />§ 12: 25 Iwments of Pan B of the RCRA applica- <br />tion). <br />AqurJer means a geological (omtation, group of <br />formations, or pan o(a formation that is capable <br />of yielding a significant amount of water to a will <br />or spring. <br />Area of review means the area surrounding an <br />injection well descnbtd according to the criteria <br />set forth in § 146.06 or m the case of an area per- <br />mit, the project area plus a cocumscribing area the <br />width of wh¢h is either '/+ of a mile or a number <br />calculated according to the criteria set forth in <br />4 146.06. <br />Qrsirt,q means a pipe or tubing of approprime <br />material, of varying diameter and weight, lowered <br />into a borehole during or after drilling in order to <br />support the sides of the hole and thus prevent the <br />walls from caving, to prevent loss of drilling mud <br />into porous ground, or to prevem waer, gas, or <br />other Flutd from tittering or leaving the hole. <br />Gnaaraphic rnllnpse means the sudden and <br />utter failure of overlying "strata" caused by re- <br />moval of underlying matenals. <br />Cementing means the opermion whereby a ce- <br />ment shirty is pumped mIO a drilled hole and/or <br />forced behind the casing. <br />CrmJining bed means a body of impttmtable or <br />distinctly less permeable material stmtigraphtcally <br />adjacent to one or more aquifers. <br />Cmtfining ;one citrons a geologcal formation, <br />group of formations, or pan of a formation that is <br />capable of hmittng (fwd movement above an in- <br />jection zone. <br />Cnnmrninmu means any physical, chemical, bio- <br />logical, or radiological substance or matter in <br />water. <br />Com~enriunnl mine means an open pit or under- <br />ground excavation (or the produnion of minerals. <br />Director means the Regional Admmtsimtor. the <br />State director or the Tribal director u the context <br />requires, or an authorized rcprcsenmuve. when <br />there is no approved Smtt or Tribal program, and <br /> <br />(here is an EPA administered program, "Director" <br />means the Regional Admintstratar When (here is <br />an approved State or Tribal program, "Director" <br />normally means the State or Tribal director. In <br />some circumstances, however, EPA retains the au- <br />Ihority to take ctnain actions even when (here is <br />an approved State or Tribal program (For exam- <br />ple, when EPA has issued an NPDES pemtit prior <br />Io the approval o(a Slate program. EPA may re- <br />tain jurisdiction over thin permit after program ap- <br />proval, see § 123.69). In such cues, the term Dr- <br />recmr means the Regtonal Administrator and not <br />the Smte or Tribal direnw. <br />Dispnsul well means a well used for the dis- <br />posal of wave into a subsurfare stratum. <br />Effective dare of n UlC program means the date <br />that a Stale UIC program is approved or esmb- <br />lished by the Administrator. <br />Ermirrrgrnerual Prorertion Agem~y ("EPA") <br />means the United Stales Environmental Protection <br />Agency. <br />EPA means the United States "Environmental <br />Protection Agency." <br />Exenipred acguifer means an agut(er or its por- <br />tion that meets the cnttria in the definition of <br />"underground sowce of drinking wafer" bur <br />which has been exempted according to the proce- <br />dures of $ 1448(6), <br />Ensung mjenrnn well means an "injectton <br />well" other than a "new injection well." <br />Etpenmenml rerhnologr means a technology <br />which has not been proven feuible under the con- <br />ditions in which it is being tested <br />Facifip~ nr acntvn• means any "HWM facility," <br />UIC "injection well." NPDES "point source," or <br />Smm 404 dredge and fill activity, or any other fa- <br />cility or activity (including land or appurtenances <br />thereto) that is subject to regulation under the <br />RCRA, UIC, NPDES, or 404 programs. <br />FauG ratans a surface or zone of rock fracture <br />along which there hu been tlaplacemenl. <br />Flow' role means the volume per lime unit given <br />to the (low of goes or other fluid substance which <br />emerges from an orifice, pump, turbine or passes <br />along a conduit or channel. <br />Fluid ratans material or substance which flows <br />or moves whether in a semisolid, liquid, sludge. <br />gas, or any other form or state. <br />Farmminn means a body of rock characterized <br />by a degree of lithologic homogeneity which is <br />prevmlingly, but not necessarily, labulm and is <br />mappable on the earth's surface or traceable in the <br />subsurface. <br />Fornmliun J7uid means "fluid" presem in a <br />"(omtation" under natural conditions u opposed <br />to introduced Buids, such u drilling mud. <br />Generarur means any person, by sve location. <br />whore act or process products hazardous wale <br />idemified or lived in 40 CFR pari 161. <br />
