The Division of Minerals and Geology ("Division") is required to <br />make an approval or denial decision no later than November 24, 2001, therefore, your response to the <br />following adequacy review concerns should be submitted to the Division as soon as possible. <br />1. As required by Rule 1.6.5 (2), please submit the proof of publication of the public notice circulated <br />in the local newspaper and all owners of record of surface lands, and easement holders that are on <br />the affected land and within 200 feet of the boundary of the affected land. Proof of notice may be <br />return receipts of a Certified Mailing or by proof of personal service. <br />Rule 6.4.3 Exhibit C- Pre-mining and Mining Plan Map(s) of Affected Lands <br />2. The Pre-mining and Mining Plan Map is to depict the owners of adjacent properties. There are only <br />two owners of adjacent lands listed on the map, and both of these properties are located to the south <br />of the permit area. Please list the owners of the ]ands adjacent to the permit area located to the east, <br />north and west of the permit area. <br />Rule 6.4.4 Exhibit D- Mining_Plan <br />3. Exhibit D is defined as the Mining Plan. Exhibit D is to describe all water diversions and <br />impoundments. Exhibit G mentions that water diversions will be used during the mining process. <br />Please describe these water diversions. <br />4. Exhibit D is also [o describe the size of area(s) to be worked at any one time. The original <br />application mentions an area of 42.8 acres. Is this the maximum area that will be disturbed at any <br />given time during the project? The mine plan specifies that phases 2 and 3 will be in operation <br />
