For ease of reference, <br />we will comment on your analysis of the application using the same paragraph <br />numbering system. <br />Ttam 1'~ <br />(1) (a) The access road was an existing road when we started mining, owned <br />and operated by the D.O.E. We believe it should not be included. <br />(b) You are correct in your evaluation; the road (0.10 acres) will be ~ <br />included by addendum. ~ ~,,~ W ~ ~ ~ <br />(2) In the past no equipment has been stored off the affected land. We will <br />investigate and correct if necessary. <br />Exhibit A <br />Only "a description by reference to township, range and section to at least <br />the nearest quarter quarter section" is required under the Rules and Regulations, <br />Section 2.12 (1). A less accurate description is "Part of the SE'ySW'~, NEZSWy, <br />SW'4SFi4, NW'4SEZ Section 9, T 2 S, R 70 W, bth P.M." <br />Exhibit D <br />(1) The statement should have read: "The ditches may be moved at a later <br />date if the economics of extraction of underlying minerals makes it a <br />worthwhile project." If the ditches were to be moved, it would be <br />necessary to backfill part of the pre-1973 pit area. None of this is <br />part of this plan, and we will not expand on it in any way at this time. <br />If it becomes desirable to relocate the ditches, an amendment will be <br />filed. <br />(2) Same as paragraph 4. <br />
