The discrepancy should have been answered in the copy <br />of the regulations as they state that the permitted area is to <br />be located to the nearest quarter quarter section. This gives <br />some leeway as to the exact location within the 40 acre tract. <br />Therefore, since the pit area does in fact lie within the above <br />mentioned tract.w~.may have to adjust .the exact shape and location <br />of the pit as shown on the photo map to effectively mine <br />the gravel from the area. Be assured that we also understand <br />the disturbed area, including the access road will not exceed <br />ten acres, but will remain at or under the 9.87 acres mentioned <br />in t}:e application. <br />Item 2.. The stockpile area as shown on Exhibit C is for gravel. <br />r.s recommended in the SCS information the topsoil will be piled <br />initially on the south side of the pit. As mining commences the <br />area will be reclaimed with the topsoil and returned to use <br />by Otis Lyons for reinclusion in his farming operation. <br />This plan will minimize the material movement required by me, <br />a.nd also any erosion possibilities will be contained to not <br />e:tceed a.ny that presently exists on the property. <br />
