<br />map. <br /> <br />EXHIBIT C: Neither the map labeled Exhibit C (a) or Exhibit C (b) indicate the <br />ownership of swctures located neaz the proposed permit area in the SW 1/4 of Section l I and <br />SE NW of Section 15. The Exhibit C (b) map shows what appeazs to be a house and a short <br />access road in the SW 1/4 of Section 1 l and this inspector, during the Pre-op inspection of the <br />Everhart Pit on October 1, 1997, noticed a house across the road from the proposed pit in the SE <br />G~" NW of Section 15. Both of these structures appear to be located close to, if not within, 200 feet <br />of the proposed permit azea. <br />The County should determine if these structures are within 200 feet of the land to be <br />affected by the mining operation and respond accordingly, ie. either with an appropriately revised <br />Exhibit C (a) or Exhibit C (b) map or by indicating to the Division that these structures are over <br />200 feet from proposed affected land and illustrating just what the boundazies_of the affected land <br />aze relative to the boundaries of the proposed permit azea. <br />EXHIBTI' C:The fences contained on and within 200 fee[ of the land known to be <br />affected by the mining operation aze not indicated on either of the Exhibit C maps nor is <br />~I~ ownership of the fences indicated. The definition of "Significant, Valuable and Permanent Man- <br />made Structure", ie Rule 1.1 (48), includes fences. <br />The County should provide at least one appropriately revised Exhibit C map with the <br />fences indicated that lie within 200 feet of the affected land and include the identity of the owner <br />of these fences. <br />EXHIBIT D: The narrative for this Exhibit does not include mention of the depth or <br />thickness of the gravel deposit to be mined or of the nature of the stratum lying immediately <br />below the material to be mined. <br />The County should provide a suitably revised narrative for Exhibit D and include the <br />missing information. <br />EXHIBIT D: The legend for the Mining Plan Map provided with this Exhibit does not <br />p'~ cleazly indicate which illustrated "piles" aze intended to be topsoil stockpiles and which aze the <br />product stockpiles. <br />The County should provide a suitably revised Mining Plan Map that contains the missing <br />information. (It would also be helpful if the area proposed to be affected by the mining operation <br />is outlined and identified on the map.) <br />EXHIBTT E: The Division understands that the County commits to the implementation of <br />the reclamation plan provided by the NRCS and included in this Exhibit. Leaving an undisturbed <br />strip of vegetated land between the affected azea and the nearby Red Creek, mentioned in the <br />NRCS plan, is, however, more an element of a mining rather than a reclamation plan.. While, the <br />Division was assured, during the Pre-op inspection on October 1, 1997, that the County intended <br />
