I have conducted a review of the adequacy of Pueblo County's application for the Everhart Pit
and have identified the following concerns:
j ~~ /_~sl,('r GENERAL: Rule 1.6.2 requires that the County publish, within 10 days of filing of the
j ~~"~ app tcation for the Everhart Pit, a public notice of the filing of the application in a neswpaper of
~ \-~ geq~ rat circulation in the locality of the proposed mining operation. For 112 applications, this
4~~ t~,,,q~ no~ice must be published 4 times, once a week for 4 consecutive weeks. At this point, the
~~,~s~- Dwision has no evidence that this has been done.
~ ~ The County should ensure that the public notice requirements of Rule 1.6.2 are met and
~, ^,~,6~~t~ ~ovide the required evidence of it.

p~'~ GENERAL: Rule 1.6.2 also requires that the County mail or personally serve, within 10
\ days of filing the application for the pit, a copy of the public notice to all landowners of record of
the surface and mineral rights for the affected land and to all owners of surface lands within 200
feet of the boundary of the land to be affected by the mining operation. At this point, the Division
Ol`` has no evidence that this has been done.
The County should ensure that the land and mineral ownership notice requirements of
Rule 1.6.2 are met and provide the required evidence of it.
EXHIBIT C:The map provided as part of this Exhibit, ie. the map labeled Exhibi[ C (a),
appeazs to lack the identity of the surface landowner in the SW 1/4 of Section 11 which is
immediately adjacent to the permit area of the proposed Everhart Pit.
