LmR <br />Drvi~iun Dueclnr <br />I have conducted a review of the adequacy of Pueblo County's application for the Everhart Pit <br />and have identified the following concerns: <br />j ~~ /_~sl,('r GENERAL: Rule 1.6.2 requires that the County publish, within 10 days of filing of the <br />j ~~"~ app tcation for the Everhart Pit, a public notice of the filing of the application in a neswpaper of <br />~ \-~ geq~ rat circulation in the locality of the proposed mining operation. For 112 applications, this <br />4~~ t~,,,q~ no~ice must be published 4 times, once a week for 4 consecutive weeks. At this point, the <br />~~,~s~- Dwision has no evidence that this has been done. <br />~ ~ The County should ensure that the public notice requirements of Rule 1.6.2 are met and <br />~, ^,~,6~~t~ ~ovide the required evidence of it. <br />MA <br />p~'~ GENERAL: Rule 1.6.2 also requires that the County mail or personally serve, within 10 <br />\ days of filing the application for the pit, a copy of the public notice to all landowners of record of <br />the surface and mineral rights for the affected land and to all owners of surface lands within 200 <br />feet of the boundary of the land to be affected by the mining operation. At this point, the Division <br />Ol`` has no evidence that this has been done. <br />The County should ensure that the land and mineral ownership notice requirements of <br />Rule 1.6.2 are met and provide the required evidence of it. <br />EXHIBIT C:The map provided as part of this Exhibit, ie. the map labeled Exhibi[ C (a), <br />appeazs to lack the identity of the surface landowner in the SW 1/4 of Section 11 which is <br />immediately adjacent to the permit area of the proposed Everhart Pit. <br />~~ <br />Q The County should identify this surface landowner and provide revised copies of this <br />
