DMG asks <br />CCDWP to address all of them, regardless of who raised them. <br />This letter will respond to the issues DMG identified in a section of the letter designated <br />"6.4.13 Exhibit M -Other Permits and Licenses." <br />Resaonse to Issues Addressed in DMG Letter <br />1. Exhibit M -Necessity of Obtaining Other Permits and Licenses. <br />Exhibit M of DMG's "Adequacy Review Comments" letter identified comments from <br />Gilpin County and the City of Black Hawk, both of which raised objections based on the alleged <br />failure of CCDWP to comply with the Gilpin County special use review permit process, and <br />CCDWP's alleged failure to obtain a valid Colorado Department of Transportation state highway <br />access permit. Both objections state that MLRB may not approve a permit until CCDWP obtains <br />both of those other permits. DMG's letter asks the applicant to respond to the County's and the <br />Town's comments. <br />a. Gilnin County SUR Process: <br />Gilpin County is zoned, and the County requires a special use permit for land uses that <br />are not uses by right in a given zone district. According to the County's comment and objection <br />letters of January 3 and December 2, <br />Gilpin County requires mining operations to be permitted by <br />Special Use Review (SUR) as per Gilpin County Zoning <br />Resolution, Section 6.1.d (attached). `Exhibit A, SUR Mining <br />Limits adopted 8/12/03 (attached) (to the 12/2/04 letter]' is a <br />review process identification matrix applicable to all mining <br />activity proposed in Gilpin County ....
