<br />Rationale for Recommendation with Conditions for Approval, Over Objections; <br />Regular 112 Construction Materials Application, <br />SW TKO Joint Venture, LLC. <br />Lupton Lakes Resource, Permit No. M-2004-078 <br />April 19, 2005 <br />Revised May 2, 2005 <br />Introduction <br />On April 19, 2005, the Division of Minerals and Geology ("Division") issued its recommendation for approval with <br />conditions of a 112 Construction Materials Application, over objections. This document is intended to provide a <br />basis for the Division's recommended approval over various concerns and reasons for objection to the Lupton Lakes <br />Resource New Application, File No. M-2004-078. <br />The SW TKO Joint Venture LLC new application was found complete and considered filed with the Division on <br />January 19, 2005. The site is located east of the South Platte River approximately 2 miles south of Fort Lupton in <br />Weld County, Colorado. The property is located in Section l9, Township 1 North, Range 66 West of the Sixth <br />Principal Meridian. <br />The permit azea is 361 acres in size, The site will be mined in 18 sections ranging in size from 20 to 25 acres. <br />Mining will begin with the silt ponds and fresh water pond located on the south and north ends of the permit area <br />and will be used for the life of the mine. After the silt ponds have been completed, the mining will progress from the <br />north towards. the south. Topsoil and overburden will be stripped and stockpiled. Dewatering trenches will be <br />excavated down to groundwater to dry mine the site. Mine water will be conveyed off site and into injection wells to <br />mitigate impacts to the hydrologic balance. <br />The proposed post-mined land use for the site is two water storage reservoirs. The water reservoirs will be <br />constructed with a compacted clay liner as mining progresses. The operator will begin construction of the slope liner <br />no later than after two phases have been completely mined to bedrock. Pond 1 will be reclaimed to a water storage <br />reservoir with a surface azea of 82.5 acres and the storage capacity of 4,006 acre-feet. Pond 2 will be reclaimed to a <br />water storage reservoir with a surface area of 175 acres and the storage capacity of 7,501 acre-feet. The silt pond and <br />storage areas will be reclaimed to upland pastureland. <br />I.
