Cottony <br />Englewood, CO 80110 Division Director <br /> Natural Resource Trustee <br />RE: File No. M-2004-078; SW TKO Join[ Venture, LLC. <br />Lupton Lakes Resource; Revised Rationale for Recommendation with Conditions <br />Dear Mr. Campbell, <br />A Pre-hearing meeting was held on April 29, 2005 for the Lupton Lakes Resource 112c New Application <br />submitted by SW TKO Joint Venture, LLC. During the meeting, a few corrections were noted to the Rationale <br />for Recommendation with Conditions for Approval document. The corrections are as follows: <br />1. On page 3 Item number 5, the Division clarified the setback from the settling pond adjacent to the <br />CDOT right-of--way to the north end of the affected area will be 100-feet from [he CDOT right-of <br />way (measured from the toe of the slope). <br />2. Stipulation No. 4 noted on pages 4 and 9 has been clarified to remove the word "liner". The <br />third bullet now states, "The maximum linear feet of slope that may be disturbed and not <br />reclaimed at any given time shall be no greater than 6,000 lineal feet." <br />3. Stipulation No. 6 noted on pages 7 and 9 has been revised to include the statement, "A copy of <br />the revision shall be forwarded to the Colorado Department of Transportation (CDOT) when <br />submitted to the Division of Minerals and Geology." <br />A copy of the revised recommendation is included.
