Please ensure that you include <br />the topsoil and subsoil depths and their erodibilities. <br />Exhibit L - Reclamatian Costs (Rule 6.4.12) <br />Your figures reflect the costs of reclaiming the total 100 acres and aper-acre cost. I will use these in my own cost <br />estimate, but may also include other costs, depending on your responses to these items. Please be reminded that <br />though you will be able to perform all the reclamation less expensively that my costs will show, I must use unit <br />costs that reflect what is charged to the state by outside reclamation contractors. <br />Your 100-acre figure for reclaiming the entire permitted area raises a question concerning the presumed 50-foot <br />buffer around the perimeter of the site, which may not require any reclamation. A buffer such as this accounts for <br />about ten acres. Please clarify the width of the buffer strip, and whether there will be any need for any reclamation <br />activities there. <br />I must include the costs of mobilizing and demobilizing equipment for performing the reclamation. 'T'here is a large <br />potential contractor pool in Durango, which is not terribly distant and probably has all required equipment. <br />Please clarify why there is no cost for the placement and grading of reject material as part of the reclamation. <br />As requested above, I will need the minimum depths (or range of depths) of replaced subsoil (overburden) and <br />topsoil. <br />Equipment I expect to include in the estimate consists of a D8 dozer with ripper attachment, elevating scraper, and <br />possibly a wheeled loader. The ripper will be for eliminating compaction on former roadways and processing <br />areas, so that they may be seeded. I will probably include an. agricultural tractor with various revegetation <br />implements for the seeding, etc. If you have specific equipment in mind for any of the reclamation tasks in the <br />plan, please let me know. <br />Please be specific in your responses to the slope grading questions (see Exhibit D above) and the species to be used <br />in the seed mix (see Exhibit E above), since they will affect the bond estimate. I will wait until I have received you <br />responses before I begin to calculate a bond amount. <br />Additional Items <br />We have received the damage agreement between you and Atmos Energy, which described several operating <br />limitations or setbacks to be maintained. Since you are committing to those details, they will become part of your <br />permit and will be monitored. <br />This office must receive proof of notification of all adjoining landowners prior to the decision date. If there are, in <br />fact, additional landowners who still have not been sent notices (see Exhibit C above), please ensure that the notices <br />are sent promptly, and that I receive all proofs of notification (signed green certified mail cards) prior to the <br />decision date. <br />Your written responses and revised maps which you will be submitting to me will constitute additional materials <br />and must be additionally filed with the county clerk and recorder. Please ensure that you file a complete set of <br />these materials, obtain a receipt, and send me the receipt for the filing prior to the decision date. <br />The decision date is still set for April 28, 2003. I am required to state that if, by the close of business on the <br />decision date, your responses have not been received here and your application is therefore not adequate for <br />approval, the application may be denied. If you need additional time to prepare and submit your responses, an <br />extension to the decision date may be requested in writing. Please try to ensure that your responses are received <br />here several days before the decision date to allow time for review. <br />
