Berhan Keffelew Division of k'edanetion, <br />] 313 Sherman Street -Room 215 Mining and Sakty <br />Denver, CO 80203 <br />Mr. Keffelew, <br />We have received a copy of the limited impact operation 110(2) permit application to your office that applies <br />to a proposal by the Turquoise Connection. We have also received a copy of the conditional use permit <br />application from Teller County and a certification letter from tfie Colorado Water Quality Control Division. <br />We also have existing case file information on this existing site which has been shared with both your office <br />and Teller County. <br />The proposal is located on public land managed by the Bureau of Land Management -Royal Gorge Field <br />Office. Our office refers to this location as the Scott Blue claim held by Foster Scott. This particular public <br />land is a small remnant that was left over measuring approximately 100 by 600 fee[. The permit boundaries <br />are the same boundaries as the claim boundaries in thisrsituation. <br />We have determined the application to be complete aitd sufficient to analyze the proposal within the 43 CFR <br />3809 (mining law) and 43 CFR 3715 (surface occupancy) regulations. The submitted description of equipment <br />and maps was more clear and comprehensive than previous submissions enabling our ability to analyze the <br />proposal. <br />W e have completed our review and are submitting the following comments in regards to this proposal for your <br />consideration and in cooperation with the agreement that exists between the BLM and the CDRMS, <br />1. There are references to topsoil on site that will be used for final reclamation. It is unclear where this <br />topsoil exists in quantities that would be suitable for final reclamation. The approved permit should <br />specify the type of material and source that will be used for fmal reclamation. <br />2. There is a large pond that has been established on site resulting apparently from contact with local <br />ground water. The approved pemut should clearly outline how this water will be handled during <br />mining and after the site is reclaimed. <br />3. The permit application includes fencing the entire mining claim including a small triangular piece of <br />ground measuring approximately 30 by 30 feet located to the southeast of the public road that crosses <br />the southeast corner of the mining claim. Our office has determined this additional fencing is <br />unnecessary and should not be approved. <br />4. Over the years, occupancy of the mining claim has been a continual issue and has been discovered <br />even when not approved. Occupancy of the claim is not authorized by the Royal Gorge Field Office as <br />P <br />
