Andrus, Heine & Crane <br />September 14, 1979 <br />Page Two <br />1 ----------------------------- <br />been amended to effect compliance with the Interim Regula- <br />tory produces pursuant to Section 502 of the Surface Mining <br />Control and Reclamation Act ("SMCRA") and the interim <br />Regulations at 30 CFR Section 700.1 et seq. In addition, <br />Energy Mines 1 and 2, the only Energy Fuels' mining opera- <br />tions where federal coal is being mined, are included within <br />an approved federal mining plan pursuant to the regulations <br />at 30 CFR Section 211.10. <br />Accompanying this letter is an application for a permit with <br />respect to Energy Fuels' Mines 1 and 2 only. The application <br />is specifically directed at compliance with the regulations <br />for the Federal Lands Program pursuant to the Permanent <br />Regulatory Program under SMCRA. The accompanying permit <br />application also represents a request for a modification of <br />• Energy Fuels' existing federal mining plan as well as an <br />application for a permit or permit amendment, as appropriate, <br />from the MLRB pursuant to the recently enacted Colorado <br />Surface Coal Mining Reclamation Act, C.R.S. 1973, Section <br />34-33-101 et seq. The net effect of this request for various <br />regulatory approvals and permits is to allow for the mining <br />and exploring of a new area encompassed within a recently <br />issued federal coal lease and to bring Energy Mines I and 2, <br />as so expanded, into compliance with the Permanent Regulatory <br />Program. <br />Energy Fuels' application to revise its mining plan and for <br />state and federal permits is the next and last step prior to <br />the commencement of mining on Federal Lease C-22644 issued <br />on June 13, 1979, under the emergency leasing criteria <br />established in NRDC vs. Hughes 437 F. Supp. 981 (D.D.C. <br />1977), as amended, 454 F. Supp. 148 (D.D.C. 1978). Mining <br />• of the coal reserves contained in Lease C-22644 is necessary <br />
