been amended to effect compliance with the Interim Regula-
tory produces pursuant to Section 502 of the Surface Mining
Control and Reclamation Act ("SMCRA") and the interim
Regulations at 30 CFR Section 700.1 et seq. In addition,
Energy Mines 1 and 2, the only Energy Fuels' mining opera-
tions where federal coal is being mined, are included within
an approved federal mining plan pursuant to the regulations
at 30 CFR Section 211.10.
Accompanying this letter is an application for a permit with
respect to Energy Fuels' Mines 1 and 2 only. The application
is specifically directed at compliance with the regulations
for the Federal Lands Program pursuant to the Permanent
Regulatory Program under SMCRA. The accompanying permit
application also represents a request for a modification of
• Energy Fuels' existing federal mining plan as well as an
application for a permit or permit amendment, as appropriate,
from the MLRB pursuant to the recently enacted Colorado
Surface Coal Mining Reclamation Act, C.R.S. 1973, Section
34-33-101 et seq. The net effect of this request for various
regulatory approvals and permits is to allow for the mining
and exploring of a new area encompassed within a recently
issued federal coal lease and to bring Energy Mines I and 2,
as so expanded, into compliance with the Permanent Regulatory
Program.
Energy Fuels' application to revise its mining plan and for
state and federal permits is the next and last step prior to
the commencement of mining on Federal Lease C-22644 issued
on June 13, 1979, under the emergency leasing criteria
established in NRDC vs. Hughes 437 F. Supp. 981 (D.D.C.
1977), as amended, 454 F. Supp. 148 (D.D.C. 1978). Mining
