Exhibit G <br />"WATER OF THE U. S."/WETLANDS <br />Rio Grande submitted a request to the Army Corps of Engineers for a jurisdictional <br />determination concerning certain lands on the Pueblo property under the federal Clean <br />Water Act (CWA). The determination request sought confirmation of Rio Grande's <br />detailed technical assessment that the Rio Grande project did not affect any potential <br />wetlands within the proposed project area- which consisted of a bridge crossing corridor <br />over the St. Charles River located in Township 22 South, Range 64W, Section 18, and <br />Township 22 South, Range 65 W, Sections 1, 12, and 13.. Rio Grande received <br />confirmation from the Army Corps of Engineers on December 6, 2001, that the project <br />area does not contain any wetlands areas subject to regulation by the Army Corps of <br />Engineers under the CWA. Thus, no wetlands mitigation programs or permits need to be <br />sought in order for the project to proceed. Engirieering options are under development <br />for a bridge over the St. Charles River. If an engineering option selected further involves <br />the Army Corps of Engineer's CWA jurisdiction, Rio Grande will seek the necessary <br />approvals.
