The Stormwater discharge permit which covers the American Tunnel site is still under <br />Sunnyside Gold Corporation's name. Please contact the WQCD-Denver-Permits Unit at (303) <br />692-3500 to begin the process of transferring the Stoimwater discharge permit from Sunnyside <br />Gold to Gold King Mines. <br />This letter is your notification that the conditions at your facility as listed above constitute violations of <br />your industrial wastewater discharge permit (CDPS No. CO-0027529) and needed actions on the part <br />of Gold King Mines Corporation. Please provide a written response addressing the issues listed <br />above before December 5. 2003. Box 140 <br />Durango, Colorado 81302 <br />Comments <br />The following are comments and/or recommendations only and require no written response on your <br />part. The recommendations will enable your system to better conform to the requirements of <br />applicable design criteria or other industry standards: <br />4. In January 2003, the ownership and industrial wastewater discharge permit for the American <br />Tunnel (CDPS No. CO-0027529) was transferred from Sunnyside Gold Corporation to Gold <br />King Mines Corporation. Please see attached documentation. <br />5. Mr. Stephen Fearn is currently the Wastewater Treatment Operator in Responsible Charge for <br />this facility. Mr. Feam is under a "compliance schedule° and has until June 30, 2004 to become <br />fully cert~ed at the appropriate level to operate this wastewater treatment facility. Please see <br />attached letter for further details. <br />6. In an effort to reduce the wastewater (mine drainage) flows from the American Tunnel, <br />Sunnyside Gold has placed plugs to seal the tunnel and is currently grouting near surface <br />fractures. It is hoped to reduce the American Tunnel wastewater flows to less than 60 gpm. <br />7. The settling ponds were last dredged (cleaned out) by Sunnyside Gold in January 2003. <br />Because the wastewater treatment influent flows have been significantly reduced, Gold King <br />Mines anticipates that the settling ponds will not need to be dredged until Spring of 2004. Gold <br />King Mines will determine an appropriate sludge disposal site for the settling pond sludge prior <br />to dredging the settling ponds. <br />8. The Consent Decree between Sunnyside Gold Corporation and the Colorado Department of <br />Public Health and Environment has been completed. Please see attached "Notice of <br />Termination of Court's Jurisdiction". <br />
