Stormwater Manaeement Plan (continued) <br />k) Materials Containment (continued) <br />iv) A list which includes [he volumes or quantities of all <br />materials used, processed, or stored ac the facility which <br />represent a potential spill threat co surface waters. The <br />location of scored material shall be indicated on the <br />facility plot submitted for item iii); <br />v) An implementation schedule for additional Facilities which <br />might be required in item iii), but which are not yet <br />operational; <br />vi) A list of available outside contractors, agencies, or ocher <br />sources which could be utilized in the event of a spill in <br />order co clean up its effects. If the facility is capable <br />of handling spills in-house, this shall be documented in the <br />plan; <br />iii) Prevision for annual review and updating of the contingency <br />plan, plus resubmission of the plan co the Di~•ision if <br />conditions and/or procedures at the Facility change the <br />original plan. If no changes are appropriate, the permittee <br />shall.so indicate in the annual report described previously. <br />The foregoing provisions shall in no way render inapplicable <br />those requirements imposed by Section 311 of the Water Pollution <br />Control Act Amendments of 1972, regulations promulgated <br />thereunder, the Colorado Water Quality Control Act, and <br />regulations promulgated thereunder. This plan should be prepared <br />by a professional engineer registered in the State of Colorado. <br />Nothing herein contained shall be construed as allowing any <br />discharge co waters of the Scace ocher than through the discharge <br />points specifically authorized in this permit. Nothing herein <br />contained shall be construed as excusing any liability the <br />permictee might have, civil or criminal, for any spL11. <br />J If there is no such material present ac the site, this shall be indicated <br />in writing and submitted co the Division for review. <br />J If there is material present but the permiccee feels there is not a <br />reasonable probability of a spill impacting waters of the Scace, this <br />shall be documented in writing and submitted to the Division for review. <br />This documentation shall include; L) distance to nearest surface waters, <br />and; 2) a detailed description of any sCruccure ~.+hich pcohibics Che <br />release of maCerial onto the ground or into a conveyance system. <br />
