d) The plan shall include a list of personnel directly responsible
for scormwater management. The plan shall describe the procedures
to be followed for personnel co judge compliance with the SWMP.
e) The plan sha'_1 provide For proper trainine of affected employees
in techniques and procedures that will assure achievement of all
scared goals.
f) The permittee shall amend this plan at any time if [here is a
change in operation that will or may result in a deterioration in
the quality of pollutants addressed by this plan, or if the plan
is shown [o be ineffective in achieving the specified goals. A
copy of the amended plan shall be submitted co the Division and
the CMLRD within 30 days, along with an explanation of the reason
for the amendment. If the Division finds the amended plan to be
inadequate, or if the procedures established are shown co be
ineffective once in place, the permitcee shall develop and employ
new procedures.
g} The permitcee shall submit ar.nuai reports due on the anniversary
data of the specif'c facility certification. Each report shall be
signed and certified (sae Part I.G.6.j and shal'_ include a
statement affirming that a thorough in~peccion of all affected
operations covered under this plan has occurred ac least once per
quarter during the period covered by the report. If the
inspection detects complete conformance with the plan, this shall
be so stated. If [he inspection shows the plan Co be
inappropriate or ineffective in any area, the annual report shall
address how the permitcee has corrected or intends co correct this
deficiency. All annual reports shall become a part of this permit
by reference.
h) 'dhenever a facility or a portion of a facility ~~ncers the
pose-minine phase, it is likely chat the overall configuration of
the site will change considerably. As the land is reclaimed,
roads, railroad lines and structures will be removed, and
significanr. reshaping of [lie surface will occur. Prior co the
time when new vegetation becomes established, the surface areas
will be subject co potentially significant erosion. The permitcee
will need co cake adequate measures in order co minimize this
erosion. Therefore, ac [he time of post-mining, the permittee
sha11'amend the plan co include specific procedures to minimize
erosion and ocher factors that contribute to the discharge of
to cal suspended solids and ocher pollutants from nes+ly reclaimed
areas. A copy of the amended plan shall be submitted to the
Division and [he CMLRD with the amendment request co change from
active co post-mining requirements,
