There are no drinking water intakes within the nearly three <br />miles that either Chandler or Oak Creeks flow before discharging into the <br />Arkansas River. Because of the large dilution between whatever flow made <br />it to the Arkansas River from either Chandler Creek or Oak Creek and the <br />flow in the river, it is doubtful that surface runoff from this facility <br />would adversely impact the downstream users. In addition to the large <br />dilution, it is to be remembered that there has not been a discharge from <br />the ponds since operations began in April, 1980. Hence, no downstream <br />users have been impacted by this facility. <br />The permittee is encouraged to read the general rationale for an <br />understanding of how this permit was developed and to read the permit to <br />see what requirements exist, Within the body of the permit itself, <br />effluent limitations and monitoring requirements are specified in Parts <br />I.B. and C. and special notification requirements for effluent violations <br />are addressed in Part II.A.2.(B). <br />Based on the above information, toe Energy Fuels Coal, Inc.; Souti~field <br />Coal Loadout ponds are certified to discharge under the general permit for <br />coal mining facilities, identified as permit number COG-850000.
