!I ~~ fo ~arhy ~2~e~ <br />groundwater rights are impacted, Kerr has secured adequate water rights <br />to provide for augmentation to any affected water users. The water <br />rights available for augmentation are Tisted in Exhibit 16, Water Rights <br />Documents. <br />Monitoring Program <br />Kerr currently maintains and will continue a comprehensive monitoring <br />program for surface and groundwater quality and quantity for the <br />duration of proposed mining and reclamation operations. The monitoring <br />program serves as an integral part of Kerr's efforts to protect the <br />hydrologic balance by providing an accurate and timely method of <br />identifying and quantifying any possible concerns with respect to water <br />quality or quantity. <br />The monitoring plan is a phased program keyed to the advance of mining <br />operations. As mining advances to the north, the monitoring plan <br />expands to assure that any effects on the hydrologic balance will be <br />detected by monitoring activities. This program was approved as a minor <br />revision to the initial permit (Permit No. C-80-006) in 1984. <br />Kerr has reviewed the currently approved monitoring plan in light of <br />comments expressed by Ml.RD in their November 9, 1989 mid-term review <br />adequacy responses letter. Based upon this review, Kerr requests that <br />Phase 1 of the monitoring plan be modified to include only those <br />monitoring wells which are associated with the west outcrop of the <br />Sudduth Coal Seam. Monitoring during the past years has shown no <br />affects to the hydrologic balance of the east outcrop of the Sudduth <br />Coal Seam. Additionally, no impacts have been observed in alluvial <br />waters which have been monitored at locations remote from existing mine <br />activities. Accordingly, in response to the MLRD mid-term review <br />comments and Kerr's review of the hydrology monitoring program, Kerr <br />requests that the following seven (7) wells, be deleted from Phase 1 of <br />the monitoring plan, DH-6, 79-26, 79-27, 79-32, 79-36, AI-1 and AI-2. <br />The locations of these and the remaining monitoring wells are shown on <br />2.05.6-85R Revised - January, 1990 <br />
