With regards to wells MWH has identified as "unknown ownership" -wells DH-3B, <br />DH-5 and DH-6, the Division has found that these wells are, in fact, [he responsibility of <br />KCC. Attached are several documents that the Division believes reflects KCC's <br />ownership of the above mentioned wells. First is a page from Technical Revision 02 in <br />which KCC includes field-monitoring data for DH-6. The second aze two pages from a <br />23 January 1990 letter from ACZ to Cathy Begej (formerly with the Division) which are <br />responses from a midterm review. ACZ states that KCC wishes to drop well DH-6 from <br />their monitoring plan. The third is a page from Attachment A from ACZ, from Technical <br />Revision 08, dated 18 May 1990, requesting that well DH-6 be eliminated from the <br />monitoring plan. The fourth is a page from an adequacy response from ACZ to Cathy <br />Begej for Technical Revision O8, dated 19 September 1990 that relates to the depth of <br />well DH-3B. The fifth and final page is a historic Table 62a -Kerr Mine Area <br />Monitoring Well Inventory, which lists well DH-5 as being part of the wells KCC is <br />responsible for. <br />Additionally, the Division also believes that KCC is responsible for the sealing of well <br />BLM-34 identified in Table 1 -Wells Outside Exploration License in the 29 Januazy <br />2002 submittal from MWH to BLM. This well is also identified as DH-4 on the 20 July <br />2000 map BLM-1, submitted to the Division in a prior submittal. The Division believes <br />that KCC is responsible for this well because it, too, appears on the field-monitoring data <br />page from the Technical Revision 02 submittal as well as on the historic Table 62a -Kerr <br />Mine Area Monitoring Well Inventory, both referenced above. <br />The Division agrees with the revised completion date of 12 August 2002 for the sealing <br />of the boreholes. The Division has extended the deadline Stipulation 23 to reflect the <br />new completion date for closing the wells. A copy of Stipulation 23 is attached. <br />Please let me know if you have any questions regazding the above-mentioned monitoring <br />wells or the proposed sealing of said wells. <br />Sincerely, __ <br />James R.
